Respected Seniors, Kindly let me know that, what should be minimum basic salary we can take for an employee as minimum wages in Delhi is 8600/-. Ex. - 3000/-, 3500/-, 4000/-.

Dear Vipin,
The minimum wage rate fixed under the Minimum Wages Act has two components, Basic wage and special allowance/VDA. The Spl. Allowance/VDA is revised every six months by the State Government/Central Government. The Basic Wage is also revised with a gap a few years. You refer to the Minimum Wages Act of Delhi Government and you will find the existing Basic Wage amount.

Hi, You may pay any amount to your employee(s) but cannot pay less than the minimum wages notified by the state govt. You may act accordingly. Thanks and regards S.K.Johri

hi, keep 50% of gross salary in the basic in this case no inspection in future will raise problems like pf inspection etc

In my opinion , if the minimum wages is 8600/- it himself means that you cannot put basic + VDA == lesser then minimum wages.
Minimum wages it self means not lesser then this......if you are giving 8600/- only then there would be no other components can be added like HRA, Conveyance, etc
you have to pay minimum Basic + VDA (or only basic) = not lesser then 8600 in your region.
Please correct me seniors if i am wrong.

There are a few issues here. Rs. 8600 is for 26 days under MW Act. Thus arrive at day rate. That's the min. wage rate per day.
If you want to bifurcate the monthly or day rate into basic plus components, find out the DA pattern which can be implemented in such a way that basic plus DA amount under that particular pattern matches total MW amount, as the DA pattern may have to be maintained regularly. Otherwise simply follow the basic of MW and show allowance separately as declared by Government.

If we bifurcate as given below. Basic - 3500, HRA - 1750 Spl. allowance - 3350. Is it correct ????

We are engaging contract labour for house keeping. We are paying the minimum wages applicable for shops and establishment in Tamilnadu, but not splitting the wages
Pay and DA. We are paying a lump sum amount to the contractor according to the skills of the workmen. The contractor is dividing the lump sum into pay,da and other allowaces. To give more in the take home pay he reduces the basic pay and d.a. He is deducting the p.f amount only for the basic pay. Kindly advice how much percentage should be shown in the basic and d.a in the gross salary. Kindly clarify with relevant rules.

Please note wages = basic + VDA . Not the gross. it means if the minimum wages is 8600/- then you had to put basic +VDA not lesser then 8600/- hope you are clear!
