Dear Collecgues & Seniors,
We are a Group company, having Head Office in Kolkata with total 200 staffs. Our total strength is 3500. We took five group of staffs in 5 different Group compnies. Like 50 in Group Co. 1, 30 in B, 30 in C, 40 in D & 50 in E. We do not have any seperate code for PF nor have the Mother code for ESIC of Head Office, it is done from Factories code No. itself. Staffs who are under different Group Co. their contributions are being deposited against those Group companies code. Please let us know whether any legal complication will arise out of this or not. Moreover what should be the Governing Act. /rule for our Head Office staff members. Can we have a seperate statutory code for our Head Office and enroll all Head office staff in that code. Do we need any other formalities for our Head Office to administer seperately our Head Office staffs. Please support thru your valued opinion.

Please clarify whether your group companies are in same name/different names. If same name is there you can take one code no. from PF/ESI otherwise separate code will be better option. It also helps you to audit and account purpose.

Mr.Chatterjee,
Thanks for your response. Earlier all the Group companies had seperate names. From August'07 all theese companies has been merged in one single name. We are sendiong the order of this merger/ammulgamation to all respective authorities.

IF THESE 5 GROUP COS. ARE EXISTING WITHIN WEST BENGAL, YOU CAN ASK THE PF/ESI AUTHORITIES TO ALLOT A SINGLE COMMON CODE FOR ALL THE GROUP COMPANIES CITING THE COURT AMALGAMATION ORDER.
GENERALLY IN SUCH CASES THE ESI/PF AUTHORITIES ALLLOT THE OLDEST CODE NUMBER OUT OF THE 5 GROUP COMPANIES AS THE COMMON CODE AND CANCEL THE REMAING 4 CODE NUMBERS.
