I would like to know whether it is a statutory liability for an employer to provide a bonus to an ex-employee whose gross salary was more than Rs. 10,000/- in the last financial year 2013-14. Again, if the employer is not providing the same, can I file a complaint for the same to the Labour Office? The employee worked for more than 30 days in the previous financial year 2013-14.

As per Sec 12 of the Payment of Bonus Act 1965, employees drawing wages up to Rs. 3500 per month or less, for calculation purposes Rs. 3500 per month maximum will be taken even if an employee is drawing up to Rs. 10000 per month. So in your case, your salary is beyond Rs. 10,000 per month, so you are not eligible as per the Act.

It is NOT GROSS SALARY but basic+DA more than RS 10000/-pm that dissentitle an employee for statutory bonus. Varghese Mathew
