If the Enforcement Officer EPFO had claimed or detected some wages on which EPF contribution was due, which you have deposited after the assessment order that is with delay, the imposition of damages and interest u/s 7Q and 14B are correct and you are liable to pay since EPFO will also pay interest from retrospective effect to the employees concerned.
Another query by one Swati Kishore relating to mandatory EPF contribution for employee who's Basic salary more than 6500 is concerned, the answer depends on the fact whether the employee concerned was previously member to the EPF or not. If a employee is a existing member to EPF, the management is liable to deduct EPF at least up to the ceiling limit i.e. Rs.6500/-. The expected notification to increase the ceiling cap from Rs.6500/- to Rs.15000/- is still pending.
Form 11 meant for obtaining a declaration about membership and can be downloaded from the site.
