Hey,
I gave my resignation on 11 Aug . I have a notice period of 1 month written in my appointment letter And am probationer not a confirmed employee.
could you please Tell me if notice period is must for me And Can i pay lieu of notice for a number of days? ( For Example: I have worked For 20 days of my notice period and I pay lieu of notice for 10 days. Is this possible? )

Hi Ankush, 1. Totally that depends on Management to give you notice period or not, generally there is no need for probationers to serve notice period.

Hey Ravi, Thanks for your Reply. What if Management is telling me to stay for notice period but its not in my interest. Can i leave without completing my notice period. Is it breach of contract?

Hi, No, that will not be call breach of contract. 1. How many months probation period you have ? 2. if you want F&F settlement, then you serve the notice period.

1. my probation period is of six months. 2. yeah, the company owes me salary due of 20 days. What if i pay lieu of notice for the number of days i dont wanna work?

Dear Ankush,
If you have an appointment letter with mentioning of notice period then you have to be serve the notice period. other wise they will send you legal notice for to recovery of notice period. which is not good sign for your career. and also they will not provide you experience ceritficate which very helpful for your career and credential check.
As per my opinion plz serve for notice period this prove that you are loyal toward the organisation and your career

Due to some reasons it would be really difficult for me to complete my notice period. I tried to negotiate with my boss if i can complete the 1 month assigned task in by end of this month but he said there was no work schedule for me and he is giving me a 2 months work to complete in my notice period. which i dont think is right.
and also Regarding the partial payment of notice. is it possible?

Hi,
1. if you take 6 months experience letter what answer you may give for future company( why you left the job within 6 months), it will show bad impact n you.
2. No legal notice will effect to probation period employees.
3. The same Appointment letter states that, if employee performance will be poor during his probation period then management can take the decision to extend his probation period else terminate his employment.

Dear Ankush,
Partial payment of notice period is always open, but the hitch is that the management has to approve of the same. Also if the management has firmly said that you need to be personally present to serve the notice period, they can send you the absconding letter and also the relieving letter release will be a problem and the background verification tainted....
Therefore its advisable to serve the notice period.

Hi, Most of the companies will not provide any experience letter cum relieving letter, if employee will get separation before completing the probation period.
