Coverage under PF Act:
Total staff strength of our organization is 22 nos. out of which only two person is drawing Basic + DA Rs. 6500/- p.m. & others are drawing more than Rs. 6500/- p.m. as Basic + DA.
I would request my seniors to advise me as to whether our organization will be required to take Registration under Providend Fund & Misc Act. since the number exceeded 20 & above. In the event, if we are covered under the PF Act, only two employees will be covered on account of payment of PF contribution & rest employees are outside the purview of PF Act since they are drawing more than Rs. 6500/- p.m.

In response to your query I wish to state as follows:
The Applicability of the Act:
1) Every establishment which is a factory engaged in any industry specified in Schedule 1 and in which 20 or more persons are employed.
2) any other establishment employing 20 or more persons which Central Govt may by notification,specify in this behalf.
3) Any establishment employing even less than 20 persons can be covered voluntarily u/s 1 (4)of the Act.
Above clarification will clear your doubt.

Dear Queriest,
For applicability of PF Act to any establishment, the threshold limit of employees is headcounts of all, including of contractors' employees irrespective of any salary limit.
Even you have all the 22 employees as "excluded employees" within the meaning under the Act, you are liable for registration of your company as an establishment under the PF Act and pay Rs. 5 & Rs. 2 every month towards administrative charges of PF & EDLI respectively.
Please bear in mind, employees are drawing salary more than Rs. 6500 pm gives you absolute right to exclude them from PF. This topic is discussed many times earlier in this forum.
It need not to mention here that all the abovementioned limits of number of employees, salary, minimum administrative charges etc. are as of now.

1. So far the so called notification regarding enhancement of wage ceiling under EPF& MP Act, 1952 has not been issued.
2. The circular as attached above is only for internal circulation of EPFO and says that the notification will be issued shortly.
