Dear All,
Please provide some guidance as some one is appointed after retirement in a factory as a consultant. He is operating a machine what is the legal position, factory act, standing orders, ESIC, insurance etc.

1. Please indicate clearly on what points clarification/views are required. Whether do you want to simply ensure whether employment of a retired person is legal or not?.
2. So far as provisions of ESI Act, 1948 and rules/regulations framed thereunder is concerned, so far as I understand, there is no age condition for entitlement of benefits. There is also no age condition for becoming an insured person or employee.

We want to recruit some retired person who are retired from the services. We are a manufacturing unit. We want to recruit some person as a consultant. Tell about attendance system & other statutory liability. As retired No PF is applicable but ESI?
