Dear All,
I'm sudhakar joined a Company A this month. Now I got an offer from Company B which is my dream company which will help me in leaps and bounds in my carrier. I'm supposed to join Company B with in a week's as there is critical requirement.
I have not got any salary from Company A and as per the offer letter it says 2 months is the notice period which i need to serve or 2 months notice pay if i'm quitting during probation and after confirmation.And as mentioned in contract,if i'm failed to serve the notice,company reserves the right to recover from me, the entire notice pay salary to relieve you from the services .
Now i want to get relieved within 1 week without notice pay (as company B is not ready for buy out) and i don't want to abscond also. Please help how can i go-ahead dealing professionally with company A. Request response at the earliest.
NOTE :- Company B is aware that i joined company A recently.

What is the problem then if company A says that you have to serve 2 months notice or pay in lieu thereof only after confirmation. As you have recently joined this company and you are under probation, then you are not entitled for notice pay/period, you may resign from the company without the same.

I am bit confused to answer in response to your query. Please let me know the terms and condition of your appointment in bullet ponints.I want to know your date of joining, date of leaving or proposed date of leaving, notice period during prohabition and after confirmation.Also let me know as to whether shortfall of notice can be compensated by paying money in terms of appointment. Also let me know termination / resignation cluase.
If I know all the above information, I will be able to guide you how you can professionally handle the above situation. It is always desirable to part with the company with laughing face with high head.

Your Problem Statement: You say you are holding an offer from your dream company and they are asking you to move in within a week. The company you have just joined is asking for two months salary pay-out in lieu of notice.
Solution: Pay the two months, and join the "dream company' after all your long term prospects are important. To get something you have to forgo something. In this case it's probably your pocket, but that is the "price" you need to pay.
Without getting into ethical, moral and professional aspects, I would state, I do not see any confusion at all, it's pretty straight forward.
