Hi Sir/Madam,

There is one criminal case pending with me and my whole family regarding property dispute. The opponent is rival of our family since before my birth. They have filed the case to harass us. It's not mine individual issue, it's a family issue.

Briefing the case:

Number of person: 6 (including me, my parents, my uncle-aunt and their son).

Case history: We are living in our land for last 45-50 years. We have a neighbor residing left of our land. After the death of the owner (a old lady), her daughter and grand daughter started to live their for last 25-30 years. In 2011, when we started to reconstruct our old building on our land within the old boundary, the neighbor and her daughter filed 3 civil cases against us in Serampore High Court, Hooghly. They complained that we have forcefully occupied a small part of their land by beating them. As they are only 2 ladies, they took this disadvantage and filled three cases one by one. Among these 3 cases, in 2 of them we have not been found guilty and got release from the case by court. These 2 cases were resolved withing 6 months in 2011. But in the last case that was filled at the end of 2011, they put the allegation of criminal offense on us that we have beaten them badly and occupied some part of their land. This case is still running on Serampore Court and till date the opponent is not able to show any prove against us. We hope within next 3-4 hearings, we will be released from this case by court.

Me and my old family members are just being harassed day by day though we are innocent. This issue is well known to all our neighbors and local municipal councilor. They are the prof of our innocence.

Now my question is that- may I join TCS now? I If any of our family rival filed a false case against us to spoil our career, will they succeed?

Please help me on this.

regards

Koushik Rudra

I don’t think so if you are not convicted. — — — — — — - Pon

HI Koushik Rudra
It is advisable to inform the HR of your company about this matter of court case - a family dispute for the purpose of ancestral land, you can also inform that your family does not have any criminal background , else on antecedents verification the rival parties may provide a false information, with a view to see that you loose a good career opportunity.
You can Join the TCS company without any hesitation, but be transparent.
All the Best, My God Bless you
Thanks

Dear Koushik,
A similar question had been asked by someone (May be you) in 2013 and had a lot of responses at https://www.citehr.com/456874-will-f...ances-tcs.html Please go through that.

Hi Simhan, I was not that person in 2013. My issue is for last 3-4 days after getting a chance with TCS. Thank you very much for your precious suggestion.

Dear Mr Rudra,
Tell your prospective company HR Head of your case, specifically that you are not convicted.
The company will understand as well as appreciate truth, which in long run will be beneficial in your career.

Dear Koushik,
It is your duty to inform the prospective hirer about the pending criminal case against you. May be you should attach a copy of the Plaint filed by your neighbour and/or your counter filed thru' your advocate. Alternatively you may also attach a sworn affidavit attested by a Notary describing the case pending. Any of these would satisfy TCS about the adequacy of your profile from your side. In case if the BGV asks for other documents you might as well show these. One more suggestion, you may also file a petition seeking the orders of a competent court to relieve you from the case pleading you are not party to the dispute etc. so you will have every chance of reclusion from this case and break free.

Dear Koushik

Property matters are civil case, you need not mention anything to HR. Most of the companies are reluctant to hire people with criminal case, irrespective they have been convicted for crime or not.

It is not necessary to mention any civil case pending against you as they are not penal in nature.

Suppression of fact, when the other party has means and sources to find out the truth doesn't tantamount to a lie or a false information, so for your betterment and growth in career it is recommended that you suppress the fact and proceed with life as normal.

And in civil cases there would be never a conviction, but only specific relief, so you need not worry. Most of the people don't understand all this law points and react defensive the moment they hear about a case, hence suppress the fact and proceed with life as normal, it is very very difficult for companies to dig out such information about individual, unless your are repeated and known offender.

And even if assuming that you have a criminal case against you, you still have the right not to disclose those information, which are detrimental for your well being and growth.

Ideally you should have posted this query anonymously instead of going public with your name and company name.

OK IT IS TRCKISH POSITION..

USUALLY FAMILY RELATED CIVIL TURNED CRIMINAL SITUATIONS DO NOT ATTRACT PRIVATE EMPLOYMENTS... AS FAR ASMY KNOWLEDGE. NOWAND THEN FAMILY MATTERS LIKE WIFE OR IN LAWS DOWRY HARRASSMENT CASES........THAT AREDERIVED WITH SOME PERSONALAGENDAS LIKE FOR DIVORCE OR FOE BLACKMAILING IN LAWSFOR MORE PERMANENT ALLIMONY

.THIS IS YOUR LAND DISPUTE AND DOES NOT ATTRACT UR PLACEMENT. HOWEVER THIS CHANGES PERSON TO PERSON THAT ARE NOW IN UR hr division.

NO ONE IS THERE TO STOP YOUR PROSPECTS. AND ALL ARE THERE TO STOP U TO JOIN.

OK NOW YOU CAN UNDERSTAND ONLY AFTER THE CLOUDS MOVES AWAY THE SUN WILL BE SEEN.. ......

EVERYTHING DEPENDS ON YOUR LUCK....WAIT AS IT COMES.. ANYHOW TAKE IT EASY . BE COURAGEOUS.. NEVER LOOSE UR SELF CONFIDENCE.. THERE ARE BEST CHANCES WITH MORE COMPANIES AWAITING U. DONT THINK TCS ONLY IN INDIA.. IT IS ONE OF THE BEST COMPANIES.. SO BE BRAVE DONT DEPRESS. NOTHING WILL DISTURB YOUR CAREER... OK BE BRAVE ONCE AGAIN.. RECEIVE AND FACE THE SITUATION AS IT IS.. ONLY TIME IS GREATER THAN ALL...

Dear Mr. Kaushik,
It is ideal and be transparent on sharing the impending case lying in criminal court during discussion.
Allegations in any court in force will not lead to conviction, unless proved in Court. And Company's normally do not take this into account, unless you are convicted primarily in Criminal 'Court.
Organizations reviews individuals impact on business, in the case of conviction/s and applies service rules then. Hence do focus on your Career path.
