Sir In my Company we are giving arrears from April 2014 in July 2014.
My question is that how we pay arrears on PTax?
ex- if someones salary is 5500/- in month of May 2014 so his deduction is 175/- but if salary rise for 1000/-means 6500/- for each month as per rule total 3000/- is not applicable for P Tax how to solve this query?

Hi,
1. As per your state P.Tax according to that you may deduct and same can be deposit as land revenue.
EX:- As per Maharashtra tax slab
if any employee gross is up-to 5000 nil
5001 to 10000 = 175
so employee total earning in April is 10000 then 175, after increment 18000 then 200 rs
so remaining 25 rs you may recover.

Professional Tax is always calculated based on the take home salary of the employees.
If you are giving arrears to the employees then what you need to do is just combine both the amounts i.e his actually salary and the arrear you are paying as that will be his take home salary of that month.
As per your example if actual salary is 5500 Rs./- and arrear for that month will be 1000/- then what you need to do is add both the amount that it is 5500 +1000 = 6500/- and then look in the slab of that specific state with the bracket of 6500/-
it's not that you will deduct 175/- based on 5500/- and then will be nil or say 50/- based on 1000/-

Dear Ravi,
As per profession Tax act your salary rise april - 2014 & you get arrears on July - 2014. I suggest you what is your gross salary payable in July - 2014 with arrears amount. you may deduct professional tax amount in which is taken on current month.

The PT slabs in maharashtra are based on monthly salary, not on take home salary
(see the schedule attached to the act, as ammened)
So in case of a higher amount for arrears, is it to be considered since the monthly salary has not changed.
