Hi, i recently join this new company as their HR. one of the major task i'm working right now is the Civil (estafa) case to their previous HR personnel. After discovering by the management they issued a termination letter with immediate effect. since they have no knowledge or background with the procedures they mistakenly mailed the termination letter to this previous HR personnel without asking from someone who are more familiariaze with HR Procedures. my worry right now this might be a good part to this ex-HR and can make a file for illegal termination and instead paying the company or return the unliquidated cash advances. Anyway this ex-HR is no longer reporting before i started on this company, but we have this minutes of the meeting with her signature. on this note she admitted she use the money for her personal use and promise to return the money within a week.
can this termination letter can still be corrected? and we can still push through the civil case to their ex-HR?

Please go through the Code of Conduct of your company, misappropriation of company's fund, fraud, and usage of company's fund for personal gain can be treated as gross negligence and can be leveled upto termination of the services. To suffice a strong case do the paper work internally, that's what my view is, but still wait for seniors to respond.
