Hi All,
I just need some help as am a software engineer and working on payroll of banglore based company and my working location is gurgaon.
Since few days m facing problem against my salary . i have done my 8 months over here but since last month i didnt get my salary , as i talk to the HR manager then every time he told me that there is some technical issue occurs but my colleague already get salary .
What can i do in this situation as every time whever i called to them they told me that there is some technical issue . i dnt think that there is some technical issue , If its there then why my salary is on hold .
Just because of this issue i found lot of issue in my life like m living in my rented house , having some personal issue as well .
I dnt knw what can i do.
Kindly suggest me something to do ?

Dear Mr. Sandip,
No employer can hold salary of his employees. if any employer holds salary of the employee it becomes breach of law.
send written communication to your HR from your personal and Official email ID. If you do not get any positive reply then send the same communication by registered Post. If they are not ready to pay or not replying you positively then approach any expert lawyer and send them legal notice.
After that you can file a civil suit in the court of law.

Thanks for giving this information , i will just wait for today it self otherwise i will send a proper notice by mail , if they didnot give me proper information then i will file a complain against them.

Hi Sandeep,
Please find the root cause before taking any action. If possible once again have a word with your HR- Manager, if it didn’t work then drop a mail to his reporting officer. (---No employer harass his employee without any intention---)

Hi Janardan,
They are in Banglore and they didnot gave me proper email id of their senior manager,
I have called the concern person again and again but each time he told me that there is some technical issue ,
every month my salary gets credit on 5 but this month still am waiting for same.
My family is depended on me , my wife is in hospital and i am living in rented house.
You understand these things ,

Tell them to release you advance equivalent to your salary till the technical glitch is sorted out. Once the technical glitch is sorted out, they can adjust the advance against the salary.

Dear First of all, find out exact problem from hr side. Is there any serious technical problem or they get order from any senior person to hold your salary??
Have you done any mistake for which they hold your salary??
U talk with HR manager once again and if he will not respond properly than mail him with mark cc to CEO/VP/MD of your group. May be possible senior level of your grp are not aware about this. While putting mail, use polite language so that u will not be in fault.
If you will not get proper response from higher level, submit your complain to labour office with complete details. I m sure you will get your salary.

As Arpan mentioned try to get Salary Advance and adjust against your salary till the technical problem is sorted out, as no company would prefer to hold the salary of their employees without any reason.
Also ask if there was no technical problem for last 7-8 months then what went amiss/wrong this month, try to resolve amicably across the table.
