Dear Sir,

I am working in mid level IT consulting firm and had signed the bond with the company for 1 year which will
end in November 2014, and company has policy of 3 months notice period.

However I am getting the very good opportunity in MNC and want to change the job any how.
I am worried, if I pay the company the bond amount, will they relieve me immediately or they will also demand the
notice period.

I can't wait for the time of 3 months to join the new firm, or else I may lose opportunity.

Please guide me in case they tell me serve 3 months notice and pay the bond amount both.

Dear Promaster,
If you want to change in between employment agreement time than you need to pay only bond amount no need to serve any notice period. However kindly refer your terms and condition in your bond paper which you have singed. You should go with new firm.

Dear Promaster,

Please go through the terms & conditions of the bond carefully,which you have signed with the company.Normally the bond and notice period are not linked as both are independent. In normal conditions, once you complete the bond period,they should suitably place you in the organisation by giving you letter of appointment with new terms and conditions, which may include a notice period of one month or three month,as the case may be.

In my opinion, the company should set you free once you agree to pay the bond amount mentioned in the bond agreement without insisting you to work for three months or pay in lieu thereof. You can talk to HRD head and explain him the circumstances.I hope he will be convinced.

If the above doesn't materlised, take a risk and abandon the present job by putting an application that due to the family circustances you are not in a position to continue to work in the company.

Don't leave the opportunity you are getting in the MNC,which comes very seldom in life.My experience is that no management has ever been able to successfully recoved the bond amount as the bond itself is always ONE-SIDED where you can not leave the organisation but the management has the inherent right to show you the doors any time.

Remember If you try to be smart then They have the power of money and you would only attract their attention.
So go and discuss and show them the articles and sections in LAW but PRIVATELY in closed cabin and tell them that U know cases would not help organization but help employee only so lets close with on Mutual uderstanding. otherwise thr might be many others who are ready to be witness and leave you quickly................
If they try to be oversmart then whow them midle finger ..I.

I thank you for your valuable responses, From these replies I had got some clarity to handle the situation.
But I am wondering that, would it be possible to recover all relieving docs without paying the amount and up to what extent this can get messed up.

Dear All,
I finally put on my resignation and my company told me to pay for bond and serve the notice period of 3 months or else pay Bond Amount + 3 Months Salary to get relieved immediately.
I am really stucked in here and cant leave, I am afraid I will loose my MNC oppurtunity.
Please advice what can be done now.
