Dear friends,

Govt. has invited comments on Factories (Amendment) Bill 2014 (copy attached) which provides for following amendments:

(I) Introduction of new terms like 'hazardous substance', 'disability' etc. and amendments to existing definitions of the terms like 'hazardous process' in line with Environment Protection Act and Disability Act.

(ii) Making the manufacturer, supplier as well as the importer responsible for the safety for the plant and machinery and imposing penalty for contravention.

(iii) Introduction of a new Section 35A on provision of Personal Protective Equipment for workers exposed to various hazards.

(iv) Amendment of Sections 36 and 37 of the Act, viz. entry into confined spaces and precautions against dangerous fumes, gases etc.

(v) Preparation of emergency plan and disaster control measures in consultation with the workers' representatives in respect of factories using hazardous substances.

(vi) Amendment of Section 40B regarding appointment of Safety Officers.

(vii) Renaming of Directorate General Factory Advice Service & Labour Institutes as the Directorate General of Occupational Safety and Health so as to clearly define its role.

(viii) Provision of canteen facilities in respect of factories employing 200 or more workers instead of the present stipulation of 250 workers.

(ix) Provision of shelters or restrooms and lunchrooms in respect of factories employing 75 or more workers instead of the present stipulation of 150 workers.

(x) Amendment of Section 59 of the Act relating to extra wages for overtime.

(xi) Amendment of Section 66 of the Act relating to further restriction on employment of women.

(xii) Reduction in the eligibility criteria for entitlement of annual leave with wages from 240 days to 90 days.

(xiii) Insertion of provision relating to compounding of certain offences

(ix) Empowering the Central Govt to make rules under the Act on some of the important provisions.
