As per the Sec.2(n) of The Factories Act 1948, the director or founder of the factory is deemed to be the occupier of the factory, the person who has ultimate control over the affairs of the factory.
A Manager shall not be deemed an occupier of the Factory.

As per 1987 amendment to Factories act and as per SC decision in ' JK INDUSTRIES ltd 's case (1996 ) 6 SCC 665,the occupier of a factory of a company shall be one of the directors.
In the case of non-company factories any officer who has ultimate control over the affairs of the factory shall be occupier.
Only an owner/MD/Director can be occupier of the factory, under Factories Act. A factory manager/Unit manager/Personnel manager, could be "Manager" under Factories Act. Thanks R K Nair
