Hi,
Greetings!!!
This is Pavan. Our organization is one year old. Till now we didn't make any registration in PF & ESI. Recently we had reached to 20 Employees.We are in the process of PF & ESI registration. But Most of the people having the basic more than 6500/-that employees are not interested to take PF & ESI benefits. If we exempt that employees then remaining employees will be around 10 members.
In this situation whether i have to make PF registration or not, is it a mandatory.

Hi Pavan
First of all tell me the nature of the business.
If the total manpower is 10 and above and even if there is any 1 coverable employee the it is mandate to enroll for ESI & PF registration. Any doubts do reach me

Hi, I am working as a HR Executive in an IT firm. Our India branch is operating since 2010. Currently the total strength is only 14 out of which only 4 members are below the salary range of Rs 15,000 pm and they are not willing to avail the ESI benefits. As for ESI minimum 10 employees criteria is there. But Is it still mandatory to enroll for ESI benefits if remaining 4 employees ( falls under the ESI bracket) are not will to do so?
As you already clarified Mr. Jeevarathnam P that its mandatory. But Is it still mandatory in current situation?

Dear member,
If your unit is located in implemented area, it is definitely coverable and you are required to make compliance for 4 employees getting wages upto Rs.15000/- per month.
I could not follow as to what do you mean by the words "But Is it still mandatory in current situation". Statutory laws are required to be followed strictly and there is no question of any personal will or discretion.

Even for software companies if total employee strength is 10 and above irrespective of number of coverable employees, ESI enrollment is mandatory. Since June 2010 your organisation will be covered.
It is better that you enroll for ESI registration.
