Dear All,

I was working a company for last 1.5 years but, due to unavoidable heath condition I had to leave the company.

Actually ,I formally resigned on March,2014 and was serving the notice period but body condition did not allowed me to serve the full notice period .The same has been informed to my Manager as well as HR department via email & verbally. Firstly, I requested them to reduce the notice period as I was suffering with typhoid & Dr. advised me to take rest. As per HR request I have submitted all the relevant documents to get released.

It’s already over a month, but now they are stating that they will not be providing the Relieving letter more over my 1month salary has not been paid yet along with PF amount.

Please see the below details regarding the company norms:

In the appointment letter it has mentioned 2 calendar month notice period. I have served 29 days notice period.

Also mentioned, in unavoidable circumstances Leave can be availed of as on a normal business as usual even during notice period.

I have requested several times to provide me the relieving letter, pending salary etc.But they are not supporting at all.

Please note I have sent so many emails regarding the status of my pending salary, relieving letter. But they have not replied any email or in written to me.

As my resignation had not been accepted, hence I post a letter requesting to allow me join or provide me the pending dues. As per Dr. I can resume my normal work.

Please suggest me what should I do? It would be helpful for me if you advise me how to get my relieving letter with my pending salary.

Thank you so much in advance & your suggestions are highly appreciated.

Ms.Sweta

This is really bad treatment by any employer or company.

Whatever circumstances you have discussed here in is directly indicating that responsible person/designated /concerned authority is not happy with you or with your service , it seems.

You have to decide ,if you wish to continue with same company or you are willing to join any new organisation.

if you are willing to continue and if they are not replying your e mails /phones then you should go directly to meet them, with all your medical reports, and e mails you sent to company.

Try to convince them with your logical points and let them know that after all such obstacles you are willing to continue your job and praise some thing about environment, system etc.

They may ask you to re join the company and also release your dues.

They should feel that still you are interested in doing job, i think meeting in person will solve your problem.

your medical reports, prescriptions will support you physically, there might be 2 reasons why they are so much disappointed with you, either they faced big issues due to your absence, either they got an alternate option of yours.

Think seriously about your decision , as it will directly reflect you career as well on CV.

If you are not feeling good to contact them for re joining then plz let me know, will discuss rest things.

Thank you Manish for your response.
Yes, you are absolutely right!! I have heard from one of my colleague that, during my absence they have faced some serious issues from client's end. This could be the mail reason not responding my emails & ph calls.
Could you please let me know the below point, as it seems that they are not ready to provide the pending dues.
To proceed further, do you think is these documents are sufficient for a new org. to hire me as I've appointment letter, pay slips etc?
Also let me know what are possible obstacles can be faced during my next interview & how to tackle those?
How to convince the other company to get the issue fixed?
Please suggest me anything else to be done from my end.
Kindly take this as an urgency & thank you very much in advance.

Shweta , my guess was right as you said, company has faced issues when you were on leave , hence it may be strict re action by company, did you went to meet your reporting officer or not to disclose your issues, problems, did you gave the briefings of being absent?

Well if you have finalised that you want to search and join new company then its ok.

Yes your all conversations from the very beginning when you applied for leave via application, its approval, prescriptions of doctor,test/pathology reports if any, after issues the e mail you sent to re join or to disburse your dues , keep all documents in systematized way, keep that folder as a record, while interview don't try to show records to employer many times, it shows you don't have other things to discuss, as an strong evidence you should keep with you.

Be confident, prove them that you tired your level best to continue in same company but they did not made it happen any how.

Do not blame , you may say directly that due to my illness and leave might company has faced big financial or image loss , that's why company is not entertaining me again, i am thank full to that company that it gave me a chance to serve , i hope my prior experience will definitely support me in performing new job in your company if i get chance to serve as an employee etc.

Be original, calm and positive in interview, tell them i am back now on work with all bundles of energy, confidence and zeal to prove my self at best.

If i get a chance slowly but surely i may prove that i may be an asset of your company in-spite of being employee.

You may also send me mail or communicate me at given cell no if feel any thing uncomfortable.

Best wishes for new opportunity..
