Dear HR Professionals,
I worked for a company for 2 years 8 months and again rejoined after a year and worked for another 3 years and 5 months. Due to downsizing they asked us to resign 1st week of Nov 2013 and agreed to pay the whole months salary. Which I agreed and signed on the resignation letter. Recently I read a post about Retrenchment Benefits so thought will take advise from professionals here.
Would I be eligible for Retrenchment Benefits or Gratuity?
Please let me know as I am aware of these things until read on citeHR.

Hope you might have got settlement for the initial period of 2 years & 8 months. If so then you cannot claim anything now. If you have not got any benefit that time for the initial period, then approach your HR, they can explain you the details.
In the second service for 3 + years you got the Notice Pay. Why there is a gap of 1 year. Have you got proper relieving for the first tenure. If you have not done so then how they selected for second time?
There are so many questions arise in the minds of the followers.
Give some more details about the first tenure. Relieving details, compensation details, 1 year gap, second tenure and confirm is the second tenure is the continuous service or it is considered as fresh entry.
If you give the above details our members can tell you the correct answer to your query.

Thanks very much Mr. Bhaskar, for your immediate response.
For the 1st two years 8 months there was no any kind of settlement done. I resigned myself and all I got from the company was my PF.
They re-hired me based on my previous performance and my good selves as the GM was a good preson. I rejoined as a new employee in a different department and worked there for 3 years and 5 months.
Wanted to know the policies and procedures.

Normally for Resignation cases, they cannot claim anything. In turn they have to pay the Notice pay to the company. The only benefit you can get is the PF which you got. As you have rejoined as like new employee, the old period will not be considered for calculation of any full & final benefits.

Since you have resigned you will not get retrenchment compensation.Since you do not have 5 years continuous service you won’t get gratuity also. Varghese Mathew 09961266966

Dear Paul,
As a prudent measure you should have preferred the retrenchment option rather than resignation offer. What made you not to think in these lines?. Had you opted for retrenchment there was a possibility of receiving retrenchment compensation since you were not eligible for gratuity for not completing reqd. continuous service of 5 yrs. May be now you request them to reconsider for clubbing the past service of 2.8 yrs plus 3.5 yrs, put together you might get the gratuity on the plea that you faithfully followed their suggestion of resignation as a goodwill gesture but not as a demand. Nothing wrong in trying, if you get it nothing like it. Some firms are liberal in relaxing certain conditions while downsizing in order to help the outgoing personnel. Wishes to you.
