Hi,
I worked for Mumbai based company for about 3 yrs in a Pharma company as Medical representative.Later the Manager told me to resign from the same post without any notice on 21/11/13 and without the paying salary.Later I have submitted the company properties and got NOC and submitted to HO Mumbai for the full and final settlement, still after 5 months the authority whose responsible for the same settlement is playing games with me and till date I didnt get the same amount.Hence I am planning to case file through Labor court in Bangalore.
I would be highly appreciated if you tel me about how many days to take Legal action?

Dear Abdul, First of all, you can’t file the case in labour court as nature of your work not as worker / labour. but, you may file the case in civil court.

Dear Abdul,
Being a medical representative you comes under sales promotion employee act, and all labour laws are applicable on you including industrial dispute act so you can file a case in labour court, you are authorize to do that as per industrial dispute act.

Let me correct you, medical representative are sales promotion employees and they covered by the sales promotion employees act ( condition of service) 1976. all due to sales promotion employee all the labour laws applicable on them, they have fully right to file case before deputy labour commissioner/labour court.

Dear abdul, you can file case in industrial dispute act under section 33 C2, before the labour court , where ever you were working last time.
