An Private Bank Employee associated for 6 years was terminated allged by Admin/HR stealing money, Mobile Charger of Employee & Hard Disk of a Department. But this Employee enied the same as the Mobile Charger belong to him & money he had not stolen. But in CCTV footage stealing of Hard Disk was not proved. But Admin/HR forcibly alleged the Employee was counting money though in footage it was not there. In footage it was shown the Employee was discharging the Charger though connected to his adjoining Desk\'s Socket of the Collegue who had complaint lost of the same. The Employee was shown in CCTV footage to open the Drawer, seeing something & closing the Drawer. This footage the Management proved the Employee stealing money. So cause notice was issued by HR of the Bank to the Employee stating to attend the hearing. But very strange, the proceeding Officer was only one HR Person who was forcing the Employee to admit of stealing. Even the Employee was asked by the HR to re-pay the amount to the Colleague. The Proceeding was one sided. Even the HR Person threatened the Employee to hand over him to the Police. In written Mail the Employee defended, he was innocent but no one was listened. HR was not allowing non of his Collegues or his Line Manager to interfere in the proceeding. Even the HR was ill behaved with that Employee. This incident was of 2012 Octber. Finally the Employee was terminated from his Service with full & final settlement. The Employee was transferred from Kolkata to Mumbai to IT Deptt of the Bank though this Employee never requested in written for transfer. This Employee was unable to suit a legal file against the Bank as he was having financial problem. Can any body advice whether this ex-employee suit a legal file against the Bank from Kolkata now ? Will there be any issue in his Career ? Please help.

As per my view it is too late to file a case after a period of 1 and half year, secondly do you have any evidence to prove your innocence

No Sir. There is no evidence to defend. But carrying truth "innocense". Due to financial issue could not shoot a file Sir. Any other Option Sir ?

Dear Mr. Arun, consult a lawyer and take his/her advice in this regards, as per my view without evidence it is not fruitful to fight a legal battle after a period of 18 months. No one would hear your voice of truth this is a mere fact, but only a good lawyer can suggest you whether legal is worth or not.

Hi Arun,

Look at the facts of the case:

- There is no evidence available with the employee by which innocence can be proven

- A year and a half has elapsed since the time the termination took place

- Full and final settlement was made, indicating an acceptance on part of the employee that all relationship has been terminated with the Bank

- A mere claim of stating the truth and being innocent is not enough. Whether you like it or not, there has to be evidence that can prove the case.

On the other hand, it is unlikely that filing a case against the Bank will have an impact on your career. However, it will take up time, money and effort on your part to take on an organisation, which can be crippling over a period of time.

I would concur with Saji, that while the case looks very weak, it might be best to consult a lawyer to determine whether it would make sense to fight legally. I would, however, sound a word of caution. Please be conscious of the facts of the case and do a realistic assessment lest you are taking for a ride by some unscrupulous legal adviser.

Dear All,
Can you let me know, is there any obligation for Government Labour Department to control Private Sector Employee Policy against hire & fire ? Many Employees usually afraid to go against Organisation keep in mind to lose his/her Job. But in many cases after joining Organisation, the Employees are getting frustrated the way the Company treat.
