Hello Everyone,

I am confused and lost by the way the colleges function here in AP. I have certain queries and would be really thankful if anyone could get me an answer for these please.

Query number one is, One of the faculty at an engineering college in Andhra Pradesh, who happens to be my friend, is from the northern part of India. He was asked to work on Holi for which he said a no. The management have marked him as absent and deducted his salary. Is this fair ? Second query stands as, the same guy gets only ONE casual leave and any leaves other than that are treated as LOP. Is that correct ? Third query is, the college does not pay the salary anything before the 25th of the following month or sometimes does not pay for at least 2 months. In this case what should the employee do ? Fourth query is that the management has asked the employee to submit his original certificates, which he did. He wants to quit as the academic year is come to an end as he has a personal reason which he does not want to disclose. The management is not willing to relieve him and are threatening him of dire consequences.

In Private Sector organizations it is all common.
Only one CL will be given in a month
Normally the original certificates will be taken by them, but they will give in case of need/while leaving the job
Holi is not important festival in A.P. All organizations will work.
Salary will be paid based on the funds position. may be delayed sometimes. Please co-operate with the management and gain long term benefit.

As rightly said above, Holi festival is not mandatory in AP unless it is in the list of national holidays of the organization , and the employee can not demand holiday just because he/she is from the state where Holi is celebrated as state festival.

Hello Everyone,
I work in an IT company, want to know that does companies allow Leave without pay in probationary period. If yes then how many? Is it under rules & regulations of Shop & Establishment Act. I want to make this policy in my company's rule so please share your Ideas & information as soon as possible.

Dear Ben,

Regarding your first query, leave cannot be claimed by an employee as a matter of right.If holi is an approved holiday, he can avail it as he is a north-indian. Otherwise he ought to have applied for c.l in advance and got it sanctioned.

Second, grant of C.L and its periodicity are subject to administrative exigencies only.For availing of other kinds of leave and their sanction, no surmises without going through the relevant service rules.

Third, disbursement of salary on the exact due date is the contractual obligation on the part of management.Any lapse in this regard can be brought to the notice of the Collegiate Education Department or the AICTE as the case may be.

Retention of original certificates, barring verification purpose, is not an ethical practice to be followed by the management, that too of a higher educational institution. Let your friend submit his resignation complying fully with the notice period.

Any way, it would be better to refer to the provisions, [ if any, applicable to the points and the college ] of the Andhrapradesh Recognized Private Educational Institutions Control Act,1975 or any other such Law time being in force.
