Hello Experts,
Please share the payment procedure in term of “Maternity Leave”. Whether the amount is to be paid monthly or after joining of employee (Rejoin after avail the maternity leave )? Please share your valuable suggestion in this regards.

Sir,
I will suggest you to go through Sections 5, 5A, 5B, 6, 7 & 8 of the Maternity Benefit Act, 1961 and also other provisions which prescribes procedure for payment of Maternity Benefit & Medical Bonus under said Act. One of the Sections as referred above lays down that the amount of maternity benefit shall be paid in advance by the employer on production of such proof as may be prescribed.
For complete procedure including maintenance of records etc. you can also read Rules notified under above Act by the appropriate Government in the State where your establishment is located.

As per the request of employee, you can pay salary towards maternity benefit in every month or as an advance payment to be adjustable finally or 6 weeks initially and 6 weeks payment after delivery. No hard and fast rule in payment. The rule is that you have make payment,

Mr. Gurumurthy has said aptly there is no hard and fast rule for payment method, normally employees prefer to be paid monthly as normal salary. Ask the employee if she is ok with the payment once she joins back.

No M/s Gurumurthy and Saji .If the payment for maternity leave is under MB Act 1961,there is definite rules.Read sec 6(5) of the Maternity Benefit Act,1961.

Thank you Mr. Varghese for correcting the statement, since the member has not categorically asked about the Maternity Benefit and only asked about the Maternity Leave, hence presumed that the employee must have not covered under MB Act.

is there any restriction for to start availing maternity leave, how many days maternity leave are allowed before EDD(Expected Date of Delivery) given by Doctor and remain after that, or simply certain days/weeks leaves as maternity leave no matter when start/finish...
