Dear Seniors,
I have few queries with respect of Sexual Harassment of Women at Workplace Act, 2013.
1. We are in the process of forming the Internal compliant committee so the nomination of one member from outside (NGO/Advocate) is mandatory?
2. Whom do we have to address and submit the Annual report and relavent updates?
3. Is there any due date for annual returns?
4. Is there any format priscribed for annual returns by the authority?
Request you to advice me on the above queries.

Answer to your queries are as follows
1. Nomination of one outside member on ICC (NGO/Advocate ) is mandatory
2.Formation of ICC is to be registered with local government Governing body which in your case will be Shops and establishment department of Local Ward office of Bangalore Municipality with copy to Labour commission , as such annual report is to be submitted to registration body
3 No date is specified , for uniformity it is prudent to use financial year ( you can incorporate information if you so desire in company's annual report
4.There is no format
Besides above please note that Training /workshop for employees as also of ICC on prevention of sexual harassment is mandatory as per the act and also in spirit as otherwise ICC remains only on paper with no benefit to either employee or employers

Dear Sir,
Thank you so much for your valuable advice.
I still not cleared with 2nd point - the ICC registration and correspondences should be submitted to the Labour office only right - ( respective Labour Inspector or Labour office or ALC or LC) - is there any thing to do with Bangalore Municipality?
Pls. advice.

In Mumbai monitering body for the Prevention of Sexual Harassment act is Shops and establishment office of respective ward office of MCGM , request check up with shops and establishment office at Bangalore Municipalty

Dear Mr. Jagadeesh R Bangalore In Bangalore, the Govt. is yet to notify who is the local authority. As of now, you need to form ICC as per the Act and hold meeting as per ICC. Regards.

Thanks for your reply.
So should i have to wait till further notification by Govt in this regard?
In fact, we have a internal committee functioning from last 5 yrs ( 1 chair person and 4 members) and even every year i'm been submitting correspondence to respective ALC in Bangalore. but only thing is we have to add 1 external member and conduct works shops & submit annual returns.

Hello, there is no registration for ICC to any registration body. So don't get confused.
However you have to submit all the information through your annual report to the district collectors office every year in January.
The report period will be from January to December of the previous year.
There is no specific format for the annual report, however you can induce the following information:
1.Name of your organization
2.Address
3.Registration number
4.Names of all the IC members
5.No. Of awareness sessions conducted in a year
6. No. of employees trained in a year
7. No. of cases handled in a year.
8. Whether you have a POSH policy or not
This is all you need to submit.

Dear Member,
In accordance with section 21 of the Sexual harassment of Women at Workplace ( PP&R) Act, 2013 Internal Committee shall in each calendar year in such form & and at such time as may be prescribed, an annual report & submit the same to the employer & the District Officer.
Now in accordance with Rule 14 of this Act the Committee is to prepare annual report which shall have the following details which is reproduced as under for your ready reference.
a No. of complaints received during the year.
b No. of complaints disposed off during the year.
C No. of cases pending for more than 90 days
d No. of workshops or awareness programmes against Sexual Harassment carried out:
e Nature of action taken by the employer or the District Officer
No separate performa is prescribed by the Rules of 2013. Also no time period is prescribed for submission of annual return. We do not know why it is so ?
