We are a new organization with about 35 employees. No one is getting less than 7000/- per month, and no employee is asking for PF, and neither have they had PF before.

So, my question is that I know that it is not mandatory to pay PF if the salary is above 6.5K, and if the employee does not ask for it, BUT do I need to register for PF?

Someone told me that it costs about 30,000 for PF registration. Is this true?

If you register yourself for PF Registrations, the costs are "0," and all the applications you submit can be obtained free of charge from the PF office. If you go through a consultant, they may charge according to their discretion.

Suggestion: If you have employees covered under PF or not, you should register and file Nil Monthly Returns online.

Dear Kumaracme,

In case the organization has 35 employees and no one is earning less than ₹15,000 per month, my question is whether we need to register for ESI. I am aware that it is not mandatory to pay ESI if the salary is above ₹15,000. Do we still need to register for ESI and file monthly returns?

Hi,

Please refer to the FAQs at this link. The following categories are excluded from enrollment: individuals who are earning more than Rs. 6500 at the time of joining. An employee who was earning a lower amount when joining and whose pay subsequently increased to over Rs. 6500 is required to remain a member, regardless of their salary.

Therefore, if all my employees earn above Rs. 6500 per month and have never been enrolled in EPF before, I believe there is no need to enroll any of them.

what happens if the company is not willing to enrol for PF???

When the number of employees reaches 20 or more, PF registration becomes applicable for the employer from that day onwards. PF contribution is applicable for employees whose basic salary + DA is less than 6500. Employers and employees can mutually agree not to contribute to EPF if the employee's salary exceeds Rs. 6500 per month. If your organization has 20 employees but is not registered with PF, EPFO may apply criminal charges against you.

If your company reaches 20 employees, then company registration with EPFO (Employee Provident Fund Office) is mandatory.
