Dear All
we have one thousand above employees under our company baner now the employees who have salary less = 10000 Rs are covered under ESI Act but our most of the employees are working on site location where there is no ESI hospital so because of that they are not avail the facility of ESI. our company has group accidenct policy and individual policy.
following are the question.
1) can we exempt those employees from ESI ?
2) if yes then under which they will be covered.

Hi,
Suppose there are employee's who is doing travelling in a month more than 17 days , as per law ESI is not applicable to them.
for marketing people they can comes under sales & promotion act. In which ID act is not applicable to them also ESI Act.
Pls refer sales & promotion act.

Is there any arrangement at site made by the "Principal Employer" for these hundreds of workmen for emergency medical services, check ups, etc.? Because if the premises belongs to the said "Principal Employer" and if your company has a contract with them, then this is necessary.
The facts are not clear from your query.

Hi Please check whether the employees working in the site come under ESI Implemented area. In case the place is out of coverage or Non Implemented area You need not deduct ESI for those employees.

Can you let me know which section/sub-section of this act the above is mentioned?
Am asking this with respect to the sales employees,in my organization, each of whom are based in an assigned territory across India and they travel constantly for 26 days a month to promote sales and other sales related activities.
The above mentioned statement from you would mean that none of the sales employees in my company would be affected by the ESI Act and the new amendment of wage limit rise to Rs. 15,000/-
