Dear Kriya,

So far no provision for registration of shops and establishments under the Tamilnadu Shops and Establishment Act,1947 and I am given to understand that a proposal is on the anvil.

The other thing mentioned by the members is also not of registration, if any but of approval of the festival holidays for your establishment under the Tamilnadu Industrial Establishments ( National and Festival Holidays ) Act,1958. As an industrial establishment covered by this Act, the shop or establishment should grant to its employees in each calendar year a holiday of one whole day on the 26th January, the 1st MAY, the 15th August and the 2nd October ( National holidays) and 5 other holidays for such festivals as specified by the inspector in consultation with its employer and the employees.

For this purpose the employer should, within 30 days from the commencement of work, send Form I in duplicate to the Inspector for the area mentioning the list of festivals ( a minimum of 5 in total ) proposed to be holidays in every year and on the date of sending the proposal ( FormI ), he should exhibit in the premises a notice in Form II specifying the period within which objections or suggestions of the employees should be sent to the inspector.[ better enclose a copy of this notice with the proposal for authenticating its exhibition in the establishment ].

Within 15 days from the date of exhibition, objections or suggestions should be submitted to the inspector.

After considering the proposal and objections or suggestions, if any received from the employees, the inspector will specify the festivals for which holidays are to be allowed in Form III, a copy of which should be kept exhibited conspicuously in the establishment.

Form V is the statement containing the list and dates of National and Festival holidays allowed in a particular calendar year. It should be submitted to the inspector so as to reach him before the commencement of the calendar year in which the holidays are to be allowed. In other words, it should be submitted before the 31st of December of the previous year.

No provison as of now under the TNSE Act,1947. Regarding approval of festival holidays, please follow the procedure I narrated in my reply. First find out in which Asst. Inspector of Labour's jurisdiction your establishment falls. No penalty for suo moto application though belated.
