Dear Sir/Madam, Our company is into Gratuity only now. Could you please let me know the exact procedure regarding this. Also we got a form called as "Form of appointment of beneficiary" in which it is asking for witness signature for all the employees and that too they want it as a hard copy from all the employees. There is a practical difficulty in getting it done from everyone. Could you please help me out in fixing this.

Your query is not very much clear. What do you mean by " Our company is into Gratuity only now. Could you please let me know the exact procedure regarding this". It is not upto the choice of any establishment to implement PG Act for their employees or not. It is an Act enacted by statute, which has to be implemented by the industry/establishment which comes under its purview.

Now to your practical difficulty. It is mandatory to have a hard copy of Form 'F' duly filled in and witnessed by any 2 permanent employees and countersigned by Unit HR personnel. How to get it filled as soon as possible - Pl call a meeting of sectional/departmental heads, explain the task in hand and steps you wish to take to get the job done. Call for their suggestions. When consensus is arrived, act accordingly. You can distribute sufficient number of copies of form to concerned sectional heads, who will ensure that the form is filled, signed and witnessed as required at specified place. You as a HR Manager sign the same afterwards and place it in personal file of employees concerned. OR Pl post a notice notifying employees about the intent and invite employees to fill in the form within a specified date. Then you can depute one or more clerical staff who are well versed with the job to complete the job as soon as possible. I am sure, if your unit is not employing more than 1000 employees, the job will be completed maximum within 10 days or a fortnight barring a few employees who are absent due to various reasons.

The gratuity act will be applicable to the companies as per the act eligibility immediately after the establishment of a company or establishment.
Gratuity will be payable to the employees after completion of 5 years of service and that too while leaving from the company service or after death of any employee in the middle of 5 years service to his legal heirs.
Now you need not worry about the gratuity Act. In the Act, it is very clear about the payment etc. It you want take LIC policy for gratuity coverage as per the Act, you have to proceed further after getting approval from the employer with LIC authorities for coverage..

I agree with two of the paragraphs of your mail but I have a doubt about your contention that if you want to take LIC policy for gratuity coverage as per the Act, you have to proceed further after getting approval from the employer with LIC authorities for coverage.If I am not wrong,you are probably referring to Section 4A of the Payment of Gratuity Act,1972.Though it is a fact that an amendment was brought about by inserting Section 4A vide Act 22 of 1987 in the PG Act but, to my mind, no notification for its applicability has been brought about till date.If you have some definite information about the notification for its implementation, please SHARE with me.
