A warm greetings to everybody !!!
I have couple of queries -
1. Ours is an insurance broking house, so under which ACT we should fall?
2. Employee strength to fall under labour law?
3. we have 3-4 group of companies, dealing into insurance loans and complete financial planning. so the employee strength would consists of 40-45. So what are the mandate rules and laws we need to abide?
Kindly give me an elaborate description asap

Your organisation is falls under Shops & Commercial Establishment Act, you have to be registered under S & C E Act and follow the rules of respective state. And following labour laws are applicable your organisation.
Minimum Wages Act, PF Act, ESIC Act, Prof. Tax Act, Labour Welfare Fund Act, Payment of Bonus Act, Payment of wages Act, Contract Labour Act/Rules (if you have hired 20 or more contract employees), Maternity Benefit Act (if female employees are working) etc.

Dear Friend,

In response to your quires, I like to inform you that in your establishment all labour laws will be applicable if it is an establishment.It is assumed that your establishment comes within the purview of S & E Act in your state (obtain certificate of registration).

In addition to the above, you are to comply with MW Act,Payment of Wages Act,Contract Labour Act (contract labors if employed 20 or more), Labour Welfare Act (if 10 or more employees are employed. However,please check the state rule), Gratuity Act( furnish Form-A Opening of establishment to labour dept), Payment of Bonus Act, Maternity Benefit Act & Equal Remuneration Act (if female employees are employed) ,Employment Exchange & Compulsory Notification Act, HRA Act, etc

Apart from the above, ESI Act (if 10 or more employees are employed and working), PF Act ( if 20 or more employees are employed and working), Professional Tax Act.
