Dear Seniors,
1.Whether an employee who is non coverable under ESI act is eligible for Maternity Benefits? If so, where it is mentioned in the bare act of Maternity Benefits?
2.How much does the employer has to pay her? For ex. her monthly salary is Rs.18,000/-.
3.How many days of leave she is eligible for?
4.What are all the other benefits to be paid from the employer?

Please Refer the below points:
1) If any employee not cover in ESIC, then she will consider in "The Maternity Benefits Act.1961".
2) Nothing any contribution need to pay. only she will be eligible to get the Paid Leave or medical bonus (Generally when Company take mediclaim insurance for general staffs, then only they cover the maternity benefits female staffs, so, they can get the reimbursement or cashless benefits also)
3) employee will be eligible 87 days leaves (6 weeks before delivery & 6 weeks post delivery) & can be extended till one month in case of any illness arising out of pregnancy, delivery, premature birth of child (Miscarriage, Medical termination of pregnancy or tubectomy operations).
4) Other benefits are Medical Bonus, payment of maternity benefits in case of death or a woman, Nursing Breaks, No deduction of wages in certain cases etc.

Please clarify maternity salary calculation.
Do we need to calculate maternity salary on Basic + DA or on Gross?
Can we give maternity salary in advance.

Dear Friend, Maternity calculation is on gross and you have to pay on monthly basis.
