Currently, I am working for XYZ company, and the company has signed a non-compete agreement electronically, which states that I cannot join a competitor firm. I have recently been offered a position by a competitor firm to join their company in India and work abroad. Can someone please advise if my current company can take any action against me if I decide to join the competitor firm?

In India, non-compete agreements are legally enforceable if they are reasonable in terms of duration, geographical area, and the nature of the business. If your non-compete agreement meets these criteria, your current employer can take legal action against you for joining a competitor firm, especially if the new role involves working in a similar capacity. It is advisable to review the terms of your non-compete agreement carefully and seek legal advice to understand the potential implications of joining a competitor firm. If there are concerns about the enforceability of the agreement or if you believe it is overly restrictive, consulting with a legal professional specializing in labor laws can provide you with a clearer understanding of your rights and options.
