What would you do if one file a complaint against you and you had to face an inquiry that won't be less then a big headache for you.
What would you do if your boss pay you for only 5hrs but force you to work for 12 or 15hrs.

Are you an HR Personnel?

I think you already know that as per the shop and establishment act, no one can be asked to work more than 9 hours a day.
The only people being exception to the rule are "Managers" and that too can not exceed 5% of the total work force in the office.
So, what is your question ? Are you talking of legal rights or moral rights ?
It depends on what your position is. If you are manger, or a highly paid person, you must have been aware that the company is offering you high pay because it expects you to work long hours. Someone doing 9-5 shifts gets paid much less.
Finally, what do you intend to on it ?
If you plan to take legal action, then how long before your company terminates you.
The private banks like HDFC are not unionised to be able to protect you.
