Dear All,
Pls suggest, one of our employee(Confirmed/staff member) is on leave past 15 days without intimation. we have sent two ltrs to resume work yet he isn\'t responded. recently he is informed his boss that over phone he not felling well(typhoid) and wants 20 days bed rest.
pls inform can we terminate his services.

Normally the terms of appointment contain a clause on 'loss of lien' on the job if an employee fails to resume duty for specified number of days.In the instant case since the employee does not respond to your letters and continues to remain absent, you can invoke that clause,if you have one and treat him to have lost his lien on the job . However ensure yourself that the communications have been sent to correct address.Even if such clause is not there, you can send him a final letter asking him to resume duty by a specified date with explanation n for his unauthorized absence and informing him that if he fails to report for duty by that date, he will be deemed to have voluntarily abandoned the job. However you cannot draw this inference if he responds to the communication and expalins the reason for his absence and expresses his intention to join duties
