hi this is selva currently i am working in a IT company in there i am getting salary only by cash and my salary is below 2L per year so it is below salary to pay tax so they said they will not provided form 16 now i am looking for a change some of the companies that i attend they are asking for bank statement and form 16 is this documents are mandatory .

But necessary for the Organisation to know the exact salary of the employees which they are going to hire. Since this the mathod of cross checking with their aary slip. It is observed that many candidates produce fake salary slip & salary certificate. And at the last stage company come to know & their entire process goes waste.

It is not mandatory to issue form 16. Your new employer is insisting only to confirm about your last drawn Salary.
Somehow you have to convenience them that it was paid in cash and as it was less than Rs.200 K p.a. the Form 16 is not issued.

Not necessary only to confirm that you were working ....best you can do is to ask for work experence letter from your last company stating your monthly salary

What you conveyed is absolutely perfect. But some cases, the candidates are not willing to disclose they are joining some other organisation and that can be one difficult for such type of candidates to obtain the Salary Certificate. I think, in such type of organisations, where the salary is also paid in cash must not following the ethics and having the command on the employee as thier own kingdom.
Getting the experience certificate / salary certificate can be difficult.

Similarly, don't you think that the company which is asking an applicant for their Form16 and Bank account statement, which are one's own personal and confidential documents; is also acting as a slave-master ??
Why can't they FIX the salary on the basis of the candidates'qualification and experience ??
Do they not have a grading system or salary structures with grades and levels ??
These are serious shortcomings on their part.

The present employer is right in demanding form 16 as under income tax act the employer is required to consolidate the income and arrive at the tax to be deducted in the salary.This especially arises when a person joins in the midst of the year.In case Form 16 is not given then a certificate showing his salary earned and hra relief and deduction of PF etc should be submitted.

Dear Chandrasekaran,
Many companies don't issue provisional Form 16 for the employees who left in midst. In such cases, Tax computation sheet or all salary slips of previous employers or F/F settlement are sufficient.
