Leave encash and notice period recovery
Hi to all of the we are having the system of calculating pl encashment on da but while calculating notice pay period we are deducting on gross salary. i have been asked frequently to adjust the notice pay period against pl balance or deduction at i want to know that whether we should adjust the notice pay period against leave balance or we should pay leave encashment on gross salary. i am aware that as per law leave encashment should be on da but there is no clarification on notice pay period recovery. please guide me on this regards arvind

Hello experts i am working in software company in gujarat. i have signed nda at the time of joining which mention that the the for of 6 from in case of any the has to the of the will be from the full and here it is not clearly mentioned that 6 months of duration after salary revision is including/excluding notice period. as i have resigned within 6 months after salary revision and i have to serve 2 months of notice period. including 2 months of notice period i am leaving the company after 6 months of salary revision. now hr is telling me that company will not pay leave encashment as you have breach the nda. company has rights to change rules of leave encashment anytime. so we will not pay you leave encashment. according to me i am not breaching the nda. as i am leaving the company after 6 months of salary revision. please provide me your valuable inputs on it. so my query is can company stop or restrict the leave encashment? has company such rights to change rules of leave encashment anytime? kindly suggest.
Notice period recovery
Dear seniors i have a query in respect of notice period recovery from the employee. if the employee does not provide the complete notice period then whether the recovery should be on gross salary or on basic salary. is there any legal reference to this point? or is it completely at the discretion of the employer. please help me in this. regards shijit.
Take leave during notice period . after notice period deduct lwp as well as notice period recovery
Dear sir i want to solution of one question? in my organization 90 day notice period. when employee put resign. one employee put resign . and after 1 month take a leave 22 day . his hod approve his leave . hr manager prepare full and final settlement after relieving . he deduct notice period recovery as well as lwp count. so i want to know they are legal aur illegal . kindly suggest me .
Pf amount recovery from full and final settlement
Hello team please anyone can suggest my below question. as of i resigned from my last company and company has also provided me releiving letterbesides they have already recoverd my leave encashmentnotice period of three months and last day s salary.now when i asked my employeer to pay my gratuity and pf amount he told me that even this would recover from your side.where i have only mentioned in my resignation that " cover notice period from f&f nothing else.please anyone can suggest me is really pf and gratuity recovered from f&f after recovering my all the amount against notice periodleaves and last 10 days salary.please suggest me where i can reply to my employeer accordingly.
Will they deduct my notice period recovery in fnf?
Hi one employee has used bad words to a other sr.employee not face to face it is sharing his feelings with his one of colleague in a company communicator and the same manager came to know about it and taken discussion and employee had accepted that am not suppos to but i have been mentally tortured so that leads to use those words. but company said u have miss used the company it so u have to give resignation and employee agreed to resing and serve notice period but hr said u can not serve notice period as per the company policy and said i will settle all the fnf till date and employee asked will my paid leave pay also given in fnf yes they said wil give pay for that and they did not mention ur notice period recovery will deduct but they asked me to mention for personal reason u are resigning job and could not serve notice period employye agreed and given resignation as per their guidence. so my query is will they deduct my notice period recovery in fnf because they did not mention that and he did not enquired about that but as per the company policy if they dont serve notice period they recover one month salary. later if they deduct the recovery of notice period how he can leagally question them for this. please help on this
