Friends,

I am going through serious trouble, first it was my resignation acceptance which i forced him to accept it, now my boss has came up with a new tactic.

On 14th August 2013 i received a good increment, but on Dec 24th 2013 i resigned as i got a good new opportunity. But now my boss says that you cant leave as i will face many financial loss n all, and to recover that you have to pay me the incremented amount back or else i will stop the relieving. Also there is no kind of bond or anything which can stop me from leaving, or there is nothing written on the increment letter. He is only doing this to take revenge from me and show other employees what problems can occur if they try to leave.

But i feel that this is against law and complete torture what is doing.

Please help me out with any legal law or some good solution or what kind of steps should i take to make everything happens smoothly.

Please help as my last working day would be 6th feb 2014, and dont want to bear any issues on last day

Dear Pratik,
First thing is that, Increment is base on your past performance not on future. they have given you the good increment, its assume that, you had done good job, which you were deserve for it, & you got that,
Now, if there are asking back the same, then check your increment letter or any communicated letter or email, whether is there anything mentioned that, if you will not continue or left between, then you have bear any of the cost..? i am sure, it must not be there..
They cant do anythings.

Yes you are right, there is nothing written about refund or any amount to be paid if I leave early.
I have said the same to him, bt how to takle this situation andwhat should I tell him in legal terms so that I get out clean.
He now tells me that you will get a cut short paid amount for the 45 days notice period, which itself is Wrong.
So tell me a solution that exactly what should I tell him, so thay his plan fails
