Dear Experts,

I need a help on one matter...

I joined one pvt ltd company in mumbai and worked there for 9 months. At the time of joining i signed a offer letter.

When i joined, after some days HR manager send me a Detail Appointment Letter with 2 copies, out of which one i have to signed and return back to HR manager. But I forgot to return it to HR Manager and both copies of appointment letter are still with me. even HR manager forgot the same and never asked me for signed copy of appointment letter.

Now, I got offer from one company and need to join immediate. I resigned from the current company without giving notice period, i offer them my one month salary in lieu of my notice period. Immediately i quit from current job and join another one.

After joining, i received Legal Notice from my past employer asking me to show cause that i have breached employment contract and to resume on duty or pay penalty of Rs. 30 Lacs.

Please help, can my previous employer can take any legal action on me in absence of my signed appointment letter ?

as you said you did not give the signed offer letter back
have you signed any other letters? if yes what or those
do you have any proof of your resignation like mail or acceptance of resignation
and proof on submission of salary in lieu for notice period (probably this will be with you as you could have by Demand draft or Bank account transfer and not by cash)
if possible get recruitment and exit policy of the company through your trusted friend from the old company
or
get the copies of so called proofs of document of breach of employment from the company directly
check for you signature authentication and other things whether it is real or copy paste of image of sign of some other document
in the mean while explain the problem with new Recruiter if they are ready to listen and help it out
after getting the documents and policy contact a legal expertise (layer) and approach with reply to the notice

I have not signed any other letter only i have signed some WDR (Work Delivery Reports) and MOM and in starting offer letter which mentioned only my joining date and offer details.
I have copy my email by which i resigned and dont have any acceptance letter from their side. I have not paid anything to them in lieu of my notice period. My last month salary is pending with them and i asked them to take that.
