Hello,

This is my first post in the group as I am in desperate need to get my Reliving Letter and Experience Letter from an Organisation that I worked with in the past.

My story goes this way:

- I have worked for 1.8 years in the Company, I had left the company in October 2011.

- I had to leave the Company on a day's notice as my new Organisation wanted me to join ASAP.

- I had to pay a sum stipulated in my contract to the Company that I was working if I did not serve my Notice Period.

- I paid them the stipulated sum of money to the Company before leaving.

- They said that they would not issue me a Reliving Letter and Experience Certificate as I was leaving on a day's notice.

- I had spoken to my Manager and HR before leaving but to no avail.

- While collecting my FnF settlement cheque also I was not allowed to read the details well, in other word it was a rush-rush scene.

- I have to them over the phone on many occasions over the phone, but they say that the Operations have not given an OK for a letter to be issued and hence they can not issue the letter.

- Someone has advised me to go and meet them once, whereas someone suggested that I should take a Cop along with me, someone suggested that I send a Notice.

Request you all to help me in this case what can I do to get the documents as I need them for future.

Dear Mr.Devenderanand,

This is what many employees do when they get a new job. When they get a new job they forget about the employer who provided the job. Leaving a job in one day's time after working for more than one year is not a sign of responsible person.

When you got a new job, you could have informed your new employer to wait for one week's time atleast and peacefully you could have discussed with your present employer about your decision and handed over all responsibilities as a responsible employee. In that situation, they would have definitely given you clearance to go ahead with your decision. Though appointment letter or confirmation letters may be stating that, employee can leave the job with one month notice from either side or to surrender notice pay for the shortfall of notice, but at the same time both employer and employee should be co-operative as both were required for each other during the period employee worked.

If you have left any job pending with them, offer them your availability on weekly off, or some time in the evening and clear all pending jobs which you may have left pending / incomplete. Be co-operative.

As you mentioned, taking a cop to the employer will not serve any purpose instead you wait for some time and request them for the same since you do not require the certificate urgently.

When you politely approach them, today or tomorrow they will help you. After all, requirement is yours..

Let us change attitude according to the situations.

Dear Mr. Manoharan,
Thank You very much for your prompt reply.
I do appreciate and conform to your points. However, would like to highlight that I had handed over all my work to my colleagues who were to take over my work after me. I had no pending tasks before leaving as all of my work was up to date.
I do understand that it was not good on my part, to act at the spur of the moment an leave the company at such a notice notice. I did try to speak to my new employer for a week's time, but they wanted me to join ASAP.
At this moment I need those letters on an urgent basis as I am facing issues during my interviews.
Kindly suggest if I have to take a legal recourse for this or not.

I have a question about Ex-gratia and bonus act.

Sirs,

Our management mail below word mail us...

Management hereby brings clarity to the following payments. Generally, all the below payments may or may not be applicable to all the employees hence should be read as applicable / eligible.



· Bonus: The Payment of Bonus will be made as per The Payment of Bonus Act, 1965 and rules there under for the employees covered under the Act as and when declared by the Company.



· Exgratia / Performance Pay: The eligible employees will be entitled for these payments who are on the roles of employment on the day of declaration / payment. Employees serving Notice period or Retrenchment or in Dismissal process are not entitled for these payments.



· Retention Pay: Employee will be eligible for this payment on successful completion of one year service and subsequently on every year completion. Employee should be on the roles of employment on the day of one year completion and on every subsequent year completion.

One thing I clear to you that Bonus / Ex-gratia ; Leave Travel Assistant ; PF ; Gratuity and Retention Pay is shown in our CTC Letter.

Please give you opinion above post.....

Dear Sumant Sir, Yes Some Employee Including all and Some employee Including all except Retention Pay. In my letter include Leave Travel assistance ; Bonus / Ex-Gratia ; PF and Gratuity.

Dear Dev,
As to your problem there cannot be a legal angle to come to your help.
Since you have not quarrelled out, you should visit the HR of the earstwhile organisation and explain your circumstances explicitly. You need not fear violence at their end. Have a face to face and one to one talk in a amicable manner. May be that this solves your problem.
In other case, please approach your friends to whom you have handed over the charge a sort of charge handover report in an informal manner. Thereafter, approach your present employer with the letter of appointment, FNF document and also the charge handover informal report and explain your problem of not getting the relieving letter for submission. As a matter of fact once you submit the FNF document no document is required to show either your appointment or relieving from the earlier employer.
I am sure your issue will get settled to your satisfaction.
