Dear Concern,
I am working as HR in an organization where every year we announce the list of holiday for all the employees. This list is approved by my Boss. It includes holidays such as republic, independence, holi, diwali, ganesh chaturthi, etc.
But we also have muslim staff working with us & every year we give them a paid leave (Note : Only to muslim staffs) during the festival of EID but do not inlude the same in the list of holiday.
Now i had received mails from few mulim staff raising the query for the same.
Need help on what shall i reply to that mail.
Your help/guidance will be truly appreciated.

What is total strength of your company? What is the strength of muslim staff? If the number is noteworthy then please please convince the boss to declare holiday on eid, else ask muslim staff to work extra and take coff on eid day.

Dear Khushbu,
This is in addition what Prashant has said. Shops and Establishment Act or Factories Act of most of the states mandate declaration of 10 closed holidays. Of these 3 closed holidays like Republic Day, Independence Day and Gandhi Jayanti are mandatory. Few s states like Karnataka or AP make it mandatory to declare closed holiday on 1st Nov as it is state formation day.
Therefore, this gives you margin of some 6-7 holidays. Of this, what is wrong in reserving one holiday for Eid if there are sufficient Muslim staffs?
Secondly, what is the nature of your industry? Does your company is required to work on all the seven days (like hotel or hospital)? In such cases managing the holidays becomes easier as Muslims work on Hindu festivals or vice versa.

Dear Khushbu,
In my previous comments let me clarify little bit. Under the provisions of The Karnataka Industrial Establishments (National and Festival Holidays) Act, 1963 it is mandatory to give 10 closed holidays per calendar year. I do not remember whether such provisions are reiterated in Factories Act or Shops and Establishment Act.
Notwithstanding the technical/legal correction gist of my suggestion remains same i.e. of the six, reserving one holiday for one community.

By the way we are a trust running educational institute. And we work 6days in a week (Mon-Sat). The total strength of employees is 45-55 approx. And no.of muslim staffs is 5. Mentioned below is the list of holidays given to our employees:

1. New Year 1st January Wednesday Full Day

2. Republic Day 26th January, 2014 Sunday Full Day

2. Holi 17th march, 2014 Monday Full Day

3. Ram Navmi 8th April, 2014 Tuesday Half Day

4. Maharashtra Day 1st May, 2014 Thursday Full Day

5. Independence Day 15th August, 2014 Friday Full Day

6. Janmashtami 18th August, 2014 Monday Half Day

7. Ganesh Chaturthi (First Day) 29th August, 2014 Friday Full Day

8. Ganesh Visarjan (Last Day) 8th September, 2014 Monday Half Day

9. Mahatma Gandhi Jayanti 2nd October, 2014 Thursday Full Day

10. Dussehra 3rd October, 2014 Friday Full Day

11. Diwali 23rd October, 2014 Thursday Full Day

12. Govardhan Pooja 24th October, 2014 Friday Full Day

i'll ask the muslim staffs to work on any of the hindu festival holidays as listed above. And can take a comp off on Bakri eid. Nice solution ....Mr.Dinesh... :-)
