Wrongful termination in pregnancy - what recourse do i have as per indian laws?
I m working with present company since last 10 months in gurgaon. yesterday all of sudden my manager called me and 4 more junior employees and said we need to resign as company is going through cash stress did not informed inperson which caused a mental harassment as well and said that i would be required to resign & then relieved from my job by july end citing reason that company is not doing good. presently i m in third month of pregnancy & its quite unlikely for me to search new job and work in new organisation. it is also surprising to notice that i was asked for resignation soon after i had informed about pregnancy to my reporting officer for information as it was essential for me to inform my reporting officer. but asking to resign was least expected and that too in front of other employees causing mental harrasment. in such situation can you advise suitable course of action. i also denied resigning but still they are forcing me to resign on immediate basis even after telling about the loss which i would incur for being jobless. can you suggest what recourse do i have as per indian laws?
Termination without prior notice period
I recently felt cheated and exploited by my employer its a pvt ltd. company which comes under factory acts when one fine day i was just asked not to come to office from the next day. the reason given is unproductiveness which is very much fake as he has promised me a salary hike to 10k and not doing so i have questioned him. 1. appointment letter didn t contain any information for probation period or so. 2. no prior notice period given for this termination 3. exploited me by taking work for coming months which he can easily use for the next few months in my absence also. 4. no salary deductions of pf and tds. 5. no form 16 given by the employer. i have worked for almost 6 months in this company. i am professional passed out of very high credential college in india having more than 3 years of experience. never thought something like this would happen to me....and believe me its the habit of these employers to do similar tricks with some previous employees of the company please tell me what should i do. i would be very grateful to you. and also i want to treat such employers a lesson who treat employees like this.
Notice period and early relieving
Hello my notice period is three months and i have put in my papers. i had resigned on 1st april 2013 and serving three months notice to the employer which falls due on 29th june 2013 and not asked for early relieving. but forcibly without giving sufficient reason and notice if my employer relieve me before 29th june 2013 then does my employer has to pay me for the difference in the notice period resulting from an early relieving? my contract letter termination clause says "your appointment can be terminated on three months prior written notice on either side. notice pay and other outstanding which may be due from you will be deducted from company dues payable to you on separation and /or recovered from you. thanks pk
