Dear All,

I am IT professional.I am working in an IT company as a Sr. Developer.This is small company having just 6 persons.I have joined my current company in Jan 2013.

After few months after my joining, my boss has been showing too much interest in my personal life.In the start, I ignore all this .But his interference has exceeds too much that One day I told him in anger to stop all this and I started ignoring him.I was mentally disturbed by this behavior but still I just concentrate on my work.

But in the mid November.He has asked me some personal questions like "Why are you talking on phone when go out of office?". " To whom you chat?" "Do you have any boyfriend?" "What if you ran away with your boyfriend?" and many more such kind of ridiculous questions.

This time my mind was totally out.I have told him not to interfere in my personal life.But still I haven't take any serious action as my family condition is such that I can't left my job at this time.

Even after this incident, I do my work with the same concentration but I keep a distance from him.But from that incident onwards,he has started finding mistake in my work and argue with me over non- sense situations.He always tried to put me down and find ways to fight with me.

Now, Today, He has asked me to leave the job.

I am ready to terminate as I want some mental peace but I am sure he will not give me experience letter or might be he'll add some ill words in my termination letter.In both the cases, my career will be lost.

Please suggest me what action can I take against him or what should I do?

What has happened with you is quite unfortunate. Nevertheless, it is better to be unemployed than working under prying boss.
Now you are longer in the employment. However, your employer has to pay your salary till 13-Dec-2013. How your salary was paid? Was it through cheque or cash or through net transfer. When you go for the collection of your salary, do not ask directly for the service-cum-employment certificate but bring up subject of "No Due Certificate". While actual typing, insert the heading as "Employment cum No Due Certificate". Include your employment details from ____ to ____. This should suffice purpose.
As such your post is out of your solicitousness. Who knows, you may have smooth sail in getting the employment certificate. Therefore, be little diplomatic. Secondly, do not ask for this certificate immediately. Approach him after 2-3 weeks. Possibly, his interest in troubling you might wither during this interlude.

Dinesh has given you good advises but one thing I could not agree (Sorry Dinesh), for a girl it is better to be unemployed than work under harassing boss.

When I wrote "it is better to be unemployed than work under prying boss", I meant she should not to feel sorry for giving up her job. As such Priya had put up with boss's nosiness. Secondly, she did not resign on her own. She was told to quit. Therefore, whatever she could have done that she has done.

In every job there is some deficiency that we need to put up with. Employers can choose the employees but employees cannot choose their bosses. Compromise is way of life. In this very forum, there are lot of posts that show harassment by one way or other by the bosses working in MNCs. But Priya's problem was that her boss's tried impinging on her personal life. You may refer similar post that had come up in the past:

The unsaid part of poster's post was that she has stood for her personal values. She did not compromise on that. If she had ingratiated her boss or extended to him unreasonable favours, possibly she could have protected her employment. But then living with values is no easy task. Many times, people do not make progress because they do not compromise with their values. This is one such example.

In such scenarios I would suggest that you should file a sexual harassment complaint. The establishment is also expected to have a committee to take up such matters even though the company employs some 6 persons. Most of the (women) employees do not go against managers or employers just because they can spoil the career of the innocent employees by not giving proper references when contacted by the prospective employers. But that will only weaken the system. After all the company is a tiny company the service certificate of that company seldom matters when you join a good organisation. Therefore, do not hesitate to file a complaint. If your establishment did not have a internal committee you can lodge your complaint before the Local Complaints Committee which is chaired by District Officer ( Normally The District Magistrate, Additional District Magistrate or District Collector or the Dy. Collector will be the Chairperson of the Local Committee).

Dinesh, can you explain me bit more about what else can I do?
Actually, I am worried about my experience letter.i.e. if he typed it like "Terminated due to bad behavior" or "Irresponsible in work"
Can I take any kind of legal action if he do like this ?

I agree and totally support Mr. Madhu's suggestion.
It is high time to teach such predators, who hound hapless victims; a befitting lesson.
With the coming in force of Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013; women and all HR professionals should take up the cudgels to fight-off such harassment and exploitation.

A big thank You for your advise.
Can you tell me the procedure to file case against him.
Should I file case right now or should wait until he gave me termination letter.
Also, can you please tell me that whether there is any bad impact of all this on my career .
