Notwithstanding my previous, it appears that you continue to tilt at the windmills. As of now wait and watch. Your question will arise only if your employer gives negative remark in the service certificate. Your excess worry may impact your fresh job search.

In case if your employer mentions negative remarks, it will benefit you. All that you need to do is to approach some lawyer and send a notice to your employer. This is because employer cannot prove your poor performance or bad behaviour. You were neither issued with any show cause notice nor any domestic enquiry was conducted. Objective of the lawyer's notice is not to take route of litigation but to scare your employer.

But before adopting this route, I strongly recommend you to handle this matter politely. Make sure that you do not lose your cool. Beseech him as much as possible. Neither you should divulge that you might give lawyer's notice. Hopefully this challenge does not arise.

Your major challenge lies in justifying to your future employers on the short stay at this company. You need to show your ingenuousness on this count rather than on worrying about the past.

Please do not abandon the post. Come back after 3-4 weeks and confirm how you could acquire the employment certificate.

Actually, I am worried about my experience letter.i.e. if he typed it like "Terminated due to bad behavior" or "Irresponsible in work"

Can I take any kind of legal action if he do like this ?

You should not mix the harassment with the act of terminating you. If you have been harassed, don't wait for collecting termination letter. Forcing you to put paper is an evident that the management has decided to send you out. It should not sound like you are registering a case just because you are asked to leave or you are going to be terminated.
As already said, in the absence of an internal committee you have to file case in the Local Committee and the procedure is very simple; you have to file it in written statement before the appropriate authority. To find out who is the appropriate authority you can meet the Labour Officer.

Hello Dinesh Sir,
I am following whatever you said.I remain calm.
Today, my boss said me that he'll not give me any termination letter.Rather he said he is giving me the verbal notice of termination and will give experience letter on 31 Dec and I have to come to office till 31 dec and do all my tasks.
Pls suggest me what should I do? Should I go to office?
Actually, I am totally blank these days and not getting what to do.

Hi,
I gone through your grievance...get experience certificate first...then you can take legal steps if they terminate you without following the principles of natural justice. Without giving show cause, charge memo and conducting domestic enquiry, the termination is not valid in the eye of law...you should handle the matter confidently and boldly...If your boss came to know that you are going to take up the issues legally, he would be scared due to guiltiness....

You don't need to get much worried about your problem because it seems to be very simple issue, Being an IT professional you should be knowing about coming with a good solution for the problem you have identified.. so kindly think twice before you act an please don't make any such decision which might become a big headache in your future so make sure in going in the smarter way , hope your boss is also an human being so just make him understand about his cheap behavior towards you..? Please try to be little patient till you come out of this issue , please don't mistake me that iwill never suggest you to tolerate him but learn to make him undesrtand about his cheap behavior and make him realize so that he's not going to continue the same with any other future employee's like you ok.. yes off-course we have to follow the ethics as you said.?but still we should remember that we are human beings and we are still improving ourselves ,Hope you must be knowing nobody is perfect..! I strongly will never support to save any onw who has done the mistake but at the same time ifeel like its my duty to make them realize of what they have done & not to repeat it again..

Because according to me, An HR should think from an versatile angle in caring for every single thing, if am wrong please suggest me the right thing, its my great opportunity to hear right suggestions from the experts, Thanking you All.
