Dear All
greetings!
Our Company registered for ESIC in october 2012 and for PF in july 2013 (we received PF letter on 8th July 2013).
We submitted ESIC till date as per rule.
And we started submission of PF August 2013 on wards here i want to clarify:
1.
PF office sent a letter ans asking us submit PF october 2012 on wards as per our ESI registartion...As per this letter they are saying that you have to submit PF as per your ESI registration as you are under PF lawa since the day you entered your firm for ESI.
2. One more thing:
if i submit PF as per PF inspector guidance as he guided submit pf for only those who were below 6500 as their basic salary...my own name is in previous list and 5-6 more candidates are in same case..so which PF account number will be followed to calculate the PF amount...like my PF is number is 8 and my account was opened in July13 ..can i submit previous amount in the same account or i have to open my new account...

Dear Mahima,

1. If an organization has 20 or more employees on any day of C.Y., then the organization will be covered under the Act. As the EPF Department has awarded your organization coverage w.e.f. October, 2012.That means, your organization might be coverable from that month. If your organization don't have coverable strength of employees then you will have to simply deposit Admin Charges only, till the strength of employees in your organization doesn't become 20. After it, the month-wise contribution can be submitted as usual.

2. The PF inspector have guided you right. As per current wages ceiling, i.e. Rs. 6,500/-, if any employee's Basic + DA is above Rs. 6,500/- then such employee will be Exempt from EPF Act. From those employees, you will need to take Form- 11 and Form- 2 from those, who are covered under the Act. But, if you also want to cover such employees, then you can simply contribute as per ceiling Rs. 6,500/-, that will Rs. 780/- maximum.

Whereas, on query of New PF A/c, then plz. note that if an employee already have a epf a/c number under a specified code, then new epf a/c cannot be opened in the name of that employee. All the due contribution can be submitted in the existing a/c.

Thanks for reply,..
One more thing which i want to as our company had 20 employees only in October 2012 than we were having only 4-5 employees/month till June13. And in those 4-5 employees only 3 employees were having their basic salary 6500 or less than 6500. So what would be Contribution rate is it would be 12% or can we submit it at 10% from October 2012 to till June 2013..as i read somewhere that if our strengths of employees are less than 20 employees in any month we can pay it at 10%..please correct me if i have something wrong in my knowledge...

Dear Mahima,
10% rate is applicable for
 Any establishment covered prior to 22.9.97 in which less than 20 employees are employed.
 Any sick industrial company and which has been declared as such by the Board for Industrial and Financial Reconstruction
 Any establishment which has at the end of any financial year, accumulated losses equal to or exceeding its entire net worth and
 Any establishment in following industries:-
(a) Jute (b) Beedi (c) Brick (d) Coir and (e) Guar gum Factories.

Dear Sir
Thanks a lot..
Sir what i am doing i am calculating all pending contributions from OCt12-Jun13 @ 12 % because we were not having so much candidates in mentioned duration..Total contribution is made upto 46k so its not impacting more if i put it @10 % too..i could just save 5k more...
Sir one more thing..i am sub,itting this contribution tomorrow in PF office...do we have to pay penalty also on that..because even we were not aware that we have to fill contribution from the date we took ESI...As i already mentioned:
1. ESIC certification was done in Oct12.
2. PF done in July13...
3. PF office sent a letter that we have to fill OCt12-June13 PF for all those whose basic is 6500 or less than...

Dear Mahima, I can’t understand why you are taking 10% of previous year. If you have been told by your PF Inspector to clear previous contributions then you should pay as per legal i.e 12%.

i am just trying to save more and more for company that is only reason for asking such kind of questions..rest after discussion on CITE i am convened that i must pay@12% so it will not create problem later...
I am paying@12% now..
