Dear Seniors,
Please clear one of my little bit confusion regarding Bonus. My company declare 20% bonus 2012-13 for all employee and gave benefit to all either their basic wage more then Rs.10,000/-.(As per bonus rule not mandatory to provide bonus whose basic wage more then Rs.10,000/-)by fixing wage on Rs. 3500/-. Now my query is during prepare Form \'C\' and submit Form \'D\' in labour office, we have to show detail of employee and their bonus amount, whose wage more than 10,000/- or we have only show detail, who was legally entitle of bonus (Basic wage less then Rs. 10,000/-).
Please clear because I have to submit return of Bonus.

Dear Mr.Pream, Ex-gratia payment is upon the discretion of management and it need not be mentioned in Form C and Form D since they are not eligible for bonus as per the said Act. Regards, Kumar

Thanks Mr. Kumar,
Now as per your suggestion, if it is not required to mention in D then please refer form D, in which point no.4 asks Total number of employee .............. and point number 5th asks 'Number of employees benefitted by bonus payment............... Is it will be the same, only forn C defined employees or in point 4 mention total employee and in 5th on form C mentioned only.

Dear Mr. Kumar,
If we will show the total no. of employee in point 4, include exgratia people and then in point 5, only mention numbers as in Form C, so both number will not match. In that condition we will have to fill detail "Whether bonus has been paid to all employees , if not, reasons for non payment (Coloumn-6)".
So what will be the reason in it as per above ground.

Respected all in bonus act annual return Total amount payable as bonus under Sec.10 or 11 of the Payment of Bonus Act, 1965 as the case may be. Fill Bonus + Exag. or Only Bonus
