it is not clear from you message whether you have an service agreement or not. in absence of service agreement, i do not think any huge amount payable to the employer. please check terms n conditions of offer, notice pay is gross salary or basic. you are looking for an year to pay notice period, would impact your pay now. please tell your present employer the commitment of notice pay and seek temp loan and pay. it better to settle the matter amicably and get your service certificate otherwise it will become unclear exit. this may have future impact.
with respect to notice pay, as per shops n establishment, it is 30days max. if they insist you can represent the matter to Labour commissioner of the area , with mail or letter sent to you. it will be resolved at their end. i see no criminal right your past employer can proceed against in the present situation, unless there is sufficient proof. yours is only a breach t n c of offer. Nothing to worry. suggest you to have a clear exit.

If you have suffering from Financial Crises and not able to pay the notice period amount, in such case consult your former employer.
If you have money, please settle down your arrears and get your exit formalities done.
However, Consider the following suggestions for second thoughts
1. Settle for a resignation acceptance letter, if your company is not providing reliving letter. (considering your financial crises)
2. explain your problems to the former employer, i am sure they may not consider your issues. Rather convince them for giving a positive reply for your during employment verifications and get a resignation acceptance letter signed. by resignation acceptance letter you may not require relieving letter etc. This letter must have your date of joining along with last working date.
