Dear All, Need ur kind suggestion on below, I'm working with one Pvt. Ltd co. since last 3 months,i have observe that the bonus cycle follow by this co. is Nov-Oct
Currently our co is not doing well, so we have decided to not to give a bonus this yr. But the employees who left from April 2013 till August 2013 we have paid bonus to them in there Full and Final. Can we Stop payment of Bonus now who left after August and current working employees?

No wages of an employee could be on hold for more than 180 days. If someone launch an compliant you will have to face the case and judgement will be in favor of those employee. But i have a question here, bonus is calculated based on the previous year's earning/surplus. So what's your methodology? if i get to know, sure will update you with a prompt one.

I would say, it's the decision should be taken by the management considering over all annual profits comparing to last couple of year and depending on the situation, either you can stop paying bonus for the year, go for less amount for bonus...or pay the bonus only to top performers.
The important thing is here that the bonus depend on the profits of the firm and if no profit on what way you plan for bonus..or suppose company goes in loss in that situation company take step to cost cutting by firing some employees to.
