I want to know IF A PRINCIPLE EMPLOYER DOES NOT HAVE PF AND ESI NO. AND IS NOT REGISTERED WITH LABOUR DEPTT., CAN HE APPOINT A CONTRACTOR HOW IS HAVING ALL ABOVE MENTIONED. Let me brief - I have an offer from a housing society to provide security and other maintenance staff on contract basis. But they do not have all these which I have mentioned above. Reason- they do not come under Factory Act, Shop and Establishment Act etc. But society is registered with registrar of societies.

Housing Societies which are formed generally to collect maintenance charges and as against to provide services such as common water supply, cleanliness, common electricity etc. For this society may not have workers which exceed 10. As such the various acts such as ESI and PF are primarily not applicable to such societies.
So, there will not be any problem for you to provide the watch and ward service to the society. However, if your strength of employees exceed the limit, your firm will be covered under the ESI and PF Acts.
