I would quite agree on what Ms. Divs. Sanil writes here.

However, I would still impress upon you to seek audience with the people concerned, and tender a heartfelt apology and plead that they give you the service certificate, else you will not be able to include this in y our c.v., at all, and will have a lot of answering to do, unless you want to change your line totally.

Think it over, and make this attempt, you might succeed, after all the one who hold responsible positions can't be mercenaries and mind you they aren't to treat you like having done a crime. You have erred, there is no doubt, but you can't be condemned, that's unfair.

If you are in Hyderabad, like I am, and if you would want to speak to me, I would welcome it, as I do know some people in Sutherland. For that I would need more details like what was your E.No., Period of Service, the Department - HR, or Operations, the name of your reporting boss, etc.

actually what the companys do is all the time they didnt accept our resignation..because they want proper reason...then what we hav to do is wait for our relieving letter...because experience very much important than money.if u wrote bond ...u can break that by my maintaining terms and conditions. then only u will get ur proper relieving...i think its importan to wait for relieving...dont quarrel with them just be patient...because there may be a chance of blacklist..........i hope it will help u bubyee cu

In your resignation, you left your services on so and so date due to some personnel problem, and you was not able to serve the notice period also. For that, you are ready to chose the PayBack option. Request them to settle your FnF account and send the Settlement Statement, you will send them the recoverable amount via Cheque in the companies name. And after that kindly issue you an experience letter.
After this, if you got the FnF Statement from them, then half of your problem will be solved. Then just send them the settlement amount and request to issue you the experience letter.

Hi I sent a letter but there was no response so met a recruitment HR in person, she asked me to contact settlement dept via e-mail, i contacted settlement dept again there was a delay so i contacted via phone they asked to pay 5599 since i did not serve notice period, i paid them in the form of draft. After then i received an e-mail that il get a service certification with the reason mentioning termination. Why should i pay an amount to get termination letter?..pls help me with this..

Dear Radhika,

I feel you slightly departed from the very good suggestions given by my fellow members. Although your company believe and work along with the culture of e-mail, (the law needs proof, which I hope e-mail is not such a proof).

You please take it, that you have not committed any crime, also to my knowledge they cannot terminate you all of a sudden. Law protects employee from the high handedness of employer when and where required.

If your employer is about to issue you a termination letter ,they may enter into trouble. Termination is a lengthy and cumbersome process, which has to be adopted only at no other go situation.

If you are not interested with the activities of your previous employer you are fully given the rights of approaching Labour Dept, if you are at Chennai it is located at Nandanam.

There you will get fair treatment. Although the majority of error seems to be on you side, it will not vest the employer to take upper hands. In a way I feel like "unfair Labour Practise".

However my humble suggestion is to go by the law of the company, wherein you may avoid issues and can get your career growth peacefully.

1. If you want to forget the Two years of service with previous Company and capable of joining any New assignment without any experience you can proceed.
2. Please,note that for any future employment, your service or experience certificate is very much essential. Since your relationship with your previous Company is not cordial due to your personal factors, the broken relationship is to be get rectified. In the meanwhile you try to meet the HR manager and persuade to accept your resignation letter as per the Company's policy or guidelines. If it fails, legal remedy is best solution.Please engage a good Lawyer expert in service matters, with all your documents related to your service in the Previous Company and do not hide any matter.
I feel other than the above,you have no short cut approach.
