Hi Sir,
My previous employer is doing my Full and Final settlement. I was relieved from the service on Jul 2013, with experience and relieving letter in hand.
They had agreed to pay the salary but now when I am following-up they are just pushing it.
Estimated F&F balance is around Rs. 55K.
Kindly let me know what I need to do, and is there any timeline within which I need to file complaint?
Also let me legally how much approx. time it will take to resolve this.

Correction, I meant my ex-employer is NOT doing Full and final settlement.

Dear Farooq,

Don't be in hurry and nothing to worry.

First of all just send an application to your previous employer and requested him that you have worked their from so and so date to so and so date. you was resigned on that date and then accordingly re-leaved on that date with experience letter and relieving letter. But, you FnF Settlement has not done till date. So, kindly settle the a/c at the earliest. Don't forget to mention your complete and correct address on that letter along with Mobile Number. This letter should be sent to the Director of that company and should be sent through only Registered AD Post, and keep tracking the Post till it got delivered.

After delivery of this letter, just wait of 15-20 days. Let them do some action on their end.

If they don't reply till 20 days, then just send them a reminder letter. Clearly mentioning that you had sent them a request earlier also on so and so date, which was delivered to them on so and so date. But, after 20 days past, you didn't received the settlement cheque from them. And, clearly mention that, if your a/c is not settled within 15 days of reminder letter, you will go to the Labour Department and lodge complaint regarding this and they will be responsible for that, and the cost of it will be payable by them.

If they still not settle you account, then you can go to the labour department and claim your fnf along with interest, in the complaint.

There may be reasons for not payning the amount.The have given you the relieving letter as well as agreed to settle the account. Do not think immediately going legally. As long as they have followed the method of relieving you the payment will have to follow. Send a letter to the MD/HR citing the relieving letter and the oral assurance givne to you for the settlement and request them to pay the money at the earliest. In my opinion there may not be any diffculty in getting the money except it is delayed. Send the letter by Regd post.

they paid my pending salary but last 3 months they didnt paid my leave encashment...
sir can you please advice and give me sample letter format...
that will be so kind of you...
