People here in India term Ex-gratia also as Bonus, there is no fixed month to distribute Ex-gratia as such or any law for the same, Ex-gratia cannot be demanded it is more or less like Tip/Bakshish by MD/Owner. Now with regards to fight through Labour Officer I would not stop you, but I don't think they will be of any help to you.
