In my opinion, we are required to maintain unclaimed wages register under State Labour Welfare Fund Act & rules.

The Unclaimed Wages and Unclaimed Bonus Register must be maintained for 3 years and the unclaimed amount pending beyond 3 years period should be intimated to the Labour Welfare Board and the amount must be used for the welfare activities of workers engaged in the organisation.

Dear Yuva,

As you may be aware that Bombay Labour welfare Fund has been extended to NCT of Delhi and the Govt of NCT of Delhi has framed their own rules to be known as 'Delhi Labour welfare Fund Rules,1997', which came into force with effective from 15.8.1998. It Section 3 of the Fund stipulates that the Labour welfare Fund shall be consists of :-

The Fund is consist of :-

(a) all fines realized from the employees;

(b) unpaid accumulations transferred to the Fund

(c) any penal interest paid

(d) any contribution paid under section 6BB;

(e) any voluntary donations

(f) any fund transferred under sub-section (5) of section 7;

(g) any sum borrowed under section 8;

(h any loan, grant-in-aid or subsidy paid by the Government.

Besides the above,all the establishments employing 5 or more workers, except those working in managerial or supervisory capacity, are liable to contribute to the Labour welfare Fund at the following rates:-

(a) Rs.0.75 paise every six months per employee as borne on the muster rolls of the establishment as on 30th June and 31st December, every year, as employees' share

(b) Rs.2.25 every six months per employee, as employer share before 15th July and 15th January every year.

The fund so generated shall be utilized for the welfare facilities of the workers of the state.
